HOW CAN RAMSDENS HELP?

We at Ramsdens believe that domestic abuse is wrong in all circumstances. We are committed to assisting victims of domestic abuse in order to stop violence.

Our professional, experienced lawyers will offer you a sympathetic ear whilst advising you of your legal position and how best to protect yourself. All information will be kept completely confidential.

During your first free initial information session we will discuss the options available to you as well as assessing your eligibility for Public Funding (Legal Aid) to fund your case.

Possible Causes of Action to Take

  • A non-molestation order - this prevents a perpetrator of domestic abuse from being violent or threatening violence towards you. It also prevents harassment, intimidation and pestering and prevents a perpetrator from instructing anybody else to do so on his behalf;
  • An Occupation Order - this can grant a victim rights in relation to the property that they live at if they do not already have the right to occupy the property. It can also require a perpetrator to leave the property and prevent them from returning in the future;
  • A warning letter - you may decide that instead of applying to the Court first, a warning letter will suffice. This will inform a perpetrator in plain English that all domestic violence should cease immediately otherwise the sufferer will make an application to Court for at least one of the above Court Orders.

At Ramsdens we will discuss all of the options with you at your appointment to determine which is the most appropriate to your case. For example it may not be appropriate to send a warning letter as this may cause further difficulties if you are still residing in the same house as the perpetrator.

We aim to make the application to the Court on the same day as your appointment if you so wish and if your case merits the application.
