The first Monday of the New Year is often referred to as ‘Divorce Day’, as statistics shows an increase in divorce enquiries following on from the New Year and Christmas period.

Separation can be a difficult and emotional time especially when it involves children. This week Resolution are celebrating Good Divorce Week and have created a guide to Parenting Through Separation, in order to help parents navigate this difficult time.

This week, we are supporting Resolution’s Good Divorce Week to help spread awareness about the ways parents can embrace a child-focused approach to separation. As part of their campaign, Resolution focus on the disputes that may arise between parties in respect of their children and how these may be resolved.

From Monday 13th September 2021, divorce applications must be submitted online using MyHMCTS, replacing the paper D8 form. This is being codified through Practice Direction 36X of the Family Procedure Rules.

When going through a divorce it is easy for animosity between parents to develop exponentially, often to the detriment of the entire family, including the children. This can lead to the children’s needs being forgotten when in fact it should be one of, if not the most important consideration during the divorce proceedings.

Ministers have announced that the Divorce, Dissolution and Separation Act 2020, which will allow married couples to divorce without assigning blame, will come into force on 6th April 2022.
