On Thursday 26th April our Corporate team hosted their second GDPR seminar alongside Fusion IT Management and Viden Consulting. The trio presented to a full house, with over 70 business professionals in attendance. Stephen Newman, Head of Corporate, discussed the significant legal changes proposed by the ICO and what businesses need to do to make sure they conform before GDPR comes into place on the 25th May. The session was engaging and informative, with many of the attendees participating in the discussion throughout the presentation. Jamie Watson, Managing Director at Fusion IT and Nathan Bown, Director at Viden Consulting then lead the discussion on technology and data protection, informing the sell-out room on the application of these changes and how to ensure that they are compliant with the forth coming regulations. This was followed by a really interactive Q&A session at the end, which many chose to stay over the set time to participate in.

The level of security granted by the borrower will depend on the nature of the loan and may often include a legal charge over real property or assets.

The recent High Court decision in Kotak v Kotak highlights the issue of bank mandates signed by one party in the context of a partnership. In this case the partnership had entered into a series of loan agreements with the bank and had signed a bank mandate that specifically required all the Partners’ signatures.

The recent Court of Appeal case Cheema v Jones and others illustrates the risk for partnerships who are operating without a formal written partnership agreement. In this case the Court of Appeal considered a dispute in relation to a medical practice. Two existing partners had invited three new partners to join the partnership and the new doctors had begun to work in the practice whilst the new partnership agreement was being negotiated.
