Our Head of Employment, David Bradley has featured in ‘The Carer’, discussing whether or not the no jab or no job policy can be enforced in the care industry.

According to David, the short answer is ‘Yes’, however, there are some caveats to this.

Talking to the publication on businesses as a whole David commented: “They [sic] are obliged (by law) to provide a safe place of work for their employees. They are also obliged to avoid endangering those that come into contact with the business and the employees of that business.”

Employers should be clear on their risk assessment and business rationale for insisting on the take up of the vaccine, be clear on the reasoning for this stance and deal with objections on a case by case basis, seeking professional advice before taking action.
