Following the government’s announcement that the State Funeral of Her Majesty Queen Elizabeth II on Monday 19 September will be a national bank holiday, our Employment team have received a number of enquiries about how this impacts employees.

The government guidance confirms that this bank holiday will operate in the same way as other bank holidays. There is no statutory entitlement to time off, and employers may include bank holidays as part of a worker’s leave entitlement.

Some employment contracts may allow for employers to stipulate certain days that should be taken as annual leave. On this basis, an employer could ask the employee to take 19 September as paid annual leave. This could be applied in the event that an employer chooses to close their business for the state funeral.

If an employer has to remain open, it is at the employer’s discretion as to whether the employee should be paid extra or entitled to additional annual leave (unless otherwise accounted for in their contract).
