Why would I want to transfer ownership of a property?

There could be a number of reasons why you want to change who is registered as the legal owner of a property. The most common changes occur when somebody gets divorced or someone dies:

  • When a couple divorces or separates, one of them may want to stay in the property and buy out the other’s share
  • When someone dies, removing their name from the property deed may be necessary in order to complete probate and distribute their estate. In this case, the name of the deceased person is often replaced with those of the beneficiaries or with a new owner

What is the process of removing a name from title deeds?

If you want to transfer ownership of a property to another party, the AP1 form should be completed. If the entire property is going to be transferred to new owners, the TR1 form should also be completed and filed with the Land Registry.

If the property is owned by two parties as joint tenants and one party dies, the surviving owner will become the sole legal owner of the property. However, if there are no surviving owners, the transfer will happen as part of the probate process.
