DIY wills are not a new phenomenon and have been around for some time. An attractive option to many, allowing a saving of a few hundred pounds. But what position can this leave your family in?

In the High Court there were 227 disputes in relation to inheritance in 2018. This number increased substantially to 368 in 2019. This increase has been fueled by the increased use of DIY wills which, unfortunately, can contain mistakes.

Insufficient guidance is provided when it comes to conflicts of interests and signing and witnessing of the documents, amongst other things, thus leaving a number of documents practically useless.

Issues commonly encountered:

  • Invalidity due to incorrect signing and witnessing
  • No appointment of executors
  • Badly worded documents causing uncertainty as to wishes
  • Disgruntled family members raising issues in relation to lack of capacity or undue influence
