The NHS Representatives have recently published a report - “Behavioural Insights into Patient Motivation to Make a Claim for Clinical Negligence” which produced data in relation to claims pursued between October 2016 and September 2017.

During this period, 1,895,834 were reported in England and Wales, of which 496,709 were reported to have caused harm to the victim.

This means that potentially, there were 496,709 claims which could have been brought against the NHS in the 2016-2017 period.

The NHS Annual Report shows that in the same period, only 10,686 claims were received by the NHS. 89.3% of people injured in this period did not pursue a claim for damages.

What is very alarming is that of the 496,709 incidents, 53% of these happened to patients over 65 years old – nearly 250,000. Only 23% of the total claims made in that period – in the region of 2,500 – were made by people over 65
