When a parent organises for their child to engage in the Scouts, they expect that their child will not only have fun and develop key skills but also will be well looked after and protected from harm.

It is shocking to think that this is not always the case, as reports of children being subjected to abuse at the hands of Scout leaders or others within the organisation are not uncommon.

The team here at Ramsdens, led by Natalie Marrison, are able to act in these cases pursuing compensation claims on behalf of the survivor and working closely to support their family whilst doing so.

It is important that a report to the Police is made as soon as possible after the abuse is discovered. This can be made by the survivor and their family, or by anyone who suspects this to be the case. The Police will appoint a Child Protection Officer who will work closely with the child and speak to them in confidence to ensure they feel protected.

Usually a claim will be made against the Association itself, who has insurance to cover any paid compensation. They can be held at fault for engaging the services of an individual who has caused the abuse and therefore failed in their responsibilities to protect the child under their care. They also may have failed to act with regard to any complaints made before or whilst the abuse was ongoing, or have made a mistake in relation to checks made to ensure safeguarding was in place.

A claim can also be made against the individual abuser, depending on assets or insurance.

At Ramsdens we will make full enquiries into all potential claims and advise as to the best course of action.

At law there is a time limit set in which to make a claim being three years from the survivor’s 18th birthday, this means that a claim should be brought before the age of 21. It is possible however to make a claim outside this time limit by asking the Court to set this aside. A court will assess whether they agree to this, taking into account the individual case details. They appreciate that it can take a survivor some years to come forward, and with this a case can proceed some years out of time.

At Ramsdens our team will be able to advise you in detail in this regard and proceed with pursuing a claim outside the time scales.

Ramsdens are able to act on any case where abuse has occurred within the Scouts Association. Our team will guide you through every step of the process, ensuring that you have a close working relationship throughout.
