A school environment should be a safe and happy one where children can learn and develop. Unfortunately, however, this is not always the case. Those in authority may abuse their role, taking advantage of a vulnerable child. The abuse can come in different forms, sexual, physical or emotional or a combination of these. The effects can be long-lasting and traumatising.

A claim can be made against the School itself, and advice also sought with regard to a claim through the Criminal Injuries Compensation Authority.


At Ramsdens we can offer advice and support on reporting child abuse to the Police. This should be done as soon as possible in order for the Police to investigate. The Police have specialist trained child protection officers who will be appointed to the case.


A school may have had knowledge of the abuse that was taking place, or it may be considered that they should have had knowledge of the abuse or should not have employed the abuser to care for children within their school. In these circumstances, a claim can be made against the school direct. The school will be liable for the actions of their employee who committed the abuse.

Alternatively, a claim can be made against the individual direct, enquiries being made as to assets that they hold or insurance that would cover them for such a claim.

A claim usually must be issued prior to the survivors 21st birthday however, where a case involves the abuse of a child the Courts recognise that the Survivor may not come forward for a number of years due to the trauma that they have experienced.
