What protections are available if I have suffered domestic abuse? 

Our solicitors can advise you on which of the two types of Court Orders available will offer the best protection for your particular set of circumstances. The court can make one or both of the following orders:

Non-Molestation Order

This provides legal restraints to someone from using or threatening violence to a person or child. It can also prevent someone from instructing or encouraging someone to use or threaten violence against a person. If a Non-Molestation Order is breached, the person can be arrested.

Occupation Order

Stating who can live in the family home, and outlining who may have to leave for a period of time to ensure protection for the victim and any children, the actual terms of the order can be wide-reaching. For example, specifying whether someone is forbidden from entering the entire home, or just an area within the home.

An Occupation Order can also prevent someone who has left the property from coming within a certain distance of it. It is possible for the court to make orders to provide protection to accommodate any unique facts of the case.

It can also provide information if there is concern about the affordability of living in a property if one of the owners is forced to leave. The court can require the partner to continue to pay for the property for a specific period of time.

Extra protection can be provided, which means that if the order is breached, the police are able to arrest the perpetrator without a warrant and bring them into custody.

The length of time that an order applies for depends on the court and your circumstances. In most cases, they apply for between six and 12 months.
