It is often the case that both Attorneys and Deputies already appointed to act on behalf of a person need to apply to the Court of Protection for permission to make a one off decision.
Attorneys and Deputies are supervised by the Office of the Public Guardian (“OPG”). The OPG are able to assist Attorneys and Deputies and guide them as to whether a decision is appropriate, but often the decision goes outside the scope of the OPG supervision and they advise people to apply to the Court of Protection for permission.
The decisions which may need Court approval include but are not limited to family care payments, gifting, sale of property, adaptations to property, etc.
