What does a Court of Protection solicitor do and how can we help?
As Court of Protection Solicitors, we provide legal support and representation for individuals who lack mental capacity to make decisions about their finances, property, health or welfare. We also provide advice to individuals acting on their behalf.
When a person lacks the mental capacity to look after their financial affairs and has not put in place a Power of Attorney, the Court of Protection will appoint a Deputy to look after their property and financial affairs. The Deputy must act in that person’s best interests, adhering to the Mental Capacity Act. The team works together to ensure that the individual who is subject to the Deputyship Order has everything they need and that their assets are protected. Ramsdens also offer professional Attorney services for those who have made a Lasting Power of Attorney and now lack capacity to manage their financial affairs.
Our Health and Welfare team advise and represent vulnerable people and their relatives on issues such as residence, contact, medical decisions and any other decisions relevant to their day to day life.
