Frequently asked questions
There could be a number of reasons why you want to change who is registered as the legal owner of a property. The most common changes occur when somebody gets divorced or someone dies:
- When a couple divorces or separates, one of them may want to stay in the property and purchase the other’s share in the property
- The name of a deceased proprietor is often replaced with those of the beneficiaries. This is called an Assent. If more than one beneficiary, it is usual for one of the beneficiaries to purchase another beneficiary’s share at the same time as the Assent which is known as an Assent and Transfer.
If the entire property is going to be transferred to new owners, the TR1 form should also be completed and filed with the Land Registry. Form AP1 should also be completed and submitted with the TR1.
If the property is owned by two parties as joint tenants and one party dies, the surviving owner will become the sole legal owner of the property. However, if there are no surviving owners, the transfer will happen as part of the probate process.
